By now, you already know my opinion of the probably-soon-to-be-law in Florida barring doctors from discussing firearms with their patients, but just to recap – it is stupid, it is unnecessary, and it pointlessly gives ammunition to the anti-rights cultists.
However, it is how those anti-rights cultists are employing that ammunition which brings us here today.
Yesterday, Joan Peterson, by way of her @commongunsense Twitter account, made the following exclamation:

My flippant, though unexpressed, response was something along the lines of, “Well, it is a good idea for self-defense experts to have medical training before asking patients about medical conditions just for the liability reasons,” but curiosity compelled me to head on over to her site (intentionally unlinked in accordance with Clause 2 of the Terms of Use) and see what she was blathering on about this time. It would appear as though commenter “jdege” made the following response to her “Scoring time for the NRA” post:

Would they be willing to sign this release form?

To which Joan Peterson (aka “japete” on her inappropriately-named “Common Gunsense” weblog) responded:

After reading that, the little imp sitting on my shoulder got a positively delightful idea – I was going to troll Joan with nothing more than that malpractice form.
And so I did.
Every comment in the thread, screencaptured to the left, written under the name of “Joe Horn” is actually me copy-pasting from the “Risk Management Advice to Physicians and Malpractice Insurance Providers: Don’t Borrow Trouble” document – Joe Horn, however, is the author of that writing, and has quite the history of dealing with similar topics:
Since retiring from the LA County Sheriff’s Department, Mr. Horn has provided Risk Management and related issue Human Resource consulting. Among other firms, he has consulted to IBM, Gates Learjet, National Semiconductor, and Pinkerton International Protection Services.
And Joan would have known that if she had bothered to read the form.
Additionally, every time I posted a comment, I linked back to the form to make it even more obvious what I was doing.
And she still never caught on, even after I copy-pasted the whole damned thing. Joan, YHBT. YHL. HAND.
Some of Joan’s comments while she railed against a script she should have already known are bordering on priceless, but the very last one is worth recording for all posterity:

We simply we not agree on this one so you can stop sending comments on this topic. Your comments reflect a point of view of a few people with extreme positions.

Amusingly, Joan allowed “Joe Horn” (me) to post one more comment after that proclamation – a woman of her word she is not.
In any case, never let Joan Peterson, or any other anti-rights cultist, tell you that they “want to have a discussion”. Never let them tell you they want to “debate the issues”. Never let them tell you they want to “have a conversation about X”. Never let them tell you they are interested in what you have to say. Never let them tell you they want to “provoke some thoughtful reflection”.
All of those statements, and any other like them, are blatant and absolute lies, as evinced by Joan’s bolded comment above. Just like hateful anti-rights organizations that would try to silence pro-rights webloggers by threatening their families, Joan does not want you to be able to express a dissenting opinion. Just like vicious anti-rights cultists who want to sterilize you if you dare to lawfully exercise your rights, Joan would irrationally label any disagreement as an “extreme”, when the opinion being expressed is demonstrably anything but. And just like the despicable bigots of history who held to the belief that one “race” is somehow better than another, Joan will never, ever be swayed by facts, figures, statistics, or reality.
And through her specious status as a “victim”, Joan Peterson is the face of “gun control”.
These are the kind of people who would despicably strip you of your Constitutionally-protected rights to self-defense and self-preservation. These are the kind of people who would rely on such reprehensible techniques as calling the Child Protective Services on someone who dares to disagree with them. These are the kind of people who knowingly aid and abet criminals through their “activism” and the legislation they support. These are the kinds of people who would uncaringly leave you and yours defenseless in the face of crime that does happen to anyone, anywhere, any time.
Do. Not. Let. Them. Win.

Something that happened quite a few times on her site was that she would post her comment before she would gate in the post that her comment addressed. It was even more confusing when you saw it on email. I don’t know if it is because of something that she is doing, or it is an artifact of the comments moderation process.
But yeah, what a goob.
Doctors are responsible for more accidental deaths then guns are:
– There are 700,000 physicians in the United States.
– There are 120,000 accidental deaths in the United States caused by physicians every year, and the accidental death percentage per physician is 0.171.
– There are 80 million gun owners in the United States.
– There are 1,500 accidental deaths from guns every year, regardless of age group, and the accidental death percentage per gun owner is 0.0000188.
This means that doctors are 9,000 times more deadly than gun owners.

Yep. Already got the firearms training, 11 months away from my M.D. Maybe Joan can help pass a bill paying for my ammo for “education on the topic of firearms.” I am against the Florida law, having already been in situations where talking about firearms was for the good of the paitent (when discussing hearing loss).

Hmm. I did not read the entire document (and I should have), but just this stand alone bit would lead me to believe that unless she provided this disclaimer that she (or the Brady Bunch, Joyce foundation, etc) could be held personally, financially and/or legally liable if someone came to serious harm by doing as they demand? Wishful thinking or possibly a dangerous precedent? It would indeed be one way to make them responsible for their words and actions.

And of course the irony is lost upon her as she decries a law that abridges the first amendment, while devoting her life’s work to abridging the second.
I’m sure that if a law were proposed forbidding doctors to discuss the benefits of firearms ownership she would be all in favor of it’s passage. It’s only a first amendment violation if they’re talking about something she agrees with.

But, by the same token, giving advice without having a solid education in the topic in hand is also quite idiotic, whether Joan is willing to admit to it or not.
@ TDC: Given that they are not doctors, they are not dispensing medical advice, and thus anyone who takes medical advice, of any sort, from them is certifiably a moron regardless, so I am not sure if you could peg them with that liability. Still, their actions and desires demonstrably aid and abet criminals, which is accountability enough in my book.
